What Is Dual Agency and Why Does SC Law Require Written Consent?

What is dual agency?

Dual agency means a single real estate agent (or sometimes two agents from the same brokerage) represents both the buyer and the seller in the same transaction. The agent must negotiate on both sides — a structural conflict of interest.

South Carolina law (SC Code § 40-57-350) requires the agent to obtain the written, informed consent of both the buyer and the seller before acting as a dual agent. Without that consent, dual agency is illegal.

What should I watch for?

Watch for: (1) your agent also holding the listing for the property you're buying; (2) your agent admitting they know the other party personally; (3) pressure to use the seller's agent as your buyer's agent; (4) no signed Dual Agency Consent Agreement before you make an offer.

Post-NAR settlement (August 17, 2024): you must sign a Buyer Representation Agreement before any agent shows you a home. If an agent resists this requirement, that is itself a red flag.
